Hello, We're writing to let you know that Mailchimp is updating our Standard Terms of Use (TOU) later today, May 15, 2019. Before the updated TOU are live on our website, you can preview them here. These changes will affect two primary areas: our pricing and our data processing addendum. You can read more about these changes below. Pricing As of today, Mailchimp is moving to a new pricing model for new paid users as well as current paid users who choose to switch to one of our new paid plan offerings. We're updating Section 7 of our TOU to reflect these changes. - Section 7A – self-tiered pricing
This section will describe how users can choose their preferred package, based on the feature set that works best for them. Then, they'll choose their projected audience to create their full pricing plan. Under this new pricing model, a user's account will no longer auto-adjust to a higher or lower paid tier based on use. - Section 7B – audience
This section will describe our new method of defining an audience of contacts based on a user's ability to market to or interact with those contacts, as well as a new archiving feature that allows users to move contacts out of their audience. We're also updating Sections 8 and 9 of our TOU, which will apply to our free plans and Pay as You Go credits, respectively. How these changes will affect you - If you are a current monthly paid user
You can keep your current monthly plan and pricing. - If you are a current Pay as You Go user
All credits purchased before May 15, 2019 will expire on May 15, 2020, and all credits purchased on or after May 15, 2019 will expire 12 months after purchase. - If you are a current free user
You can remain a free user so long as you have 2,000 or fewer contacts in your audience, and you'll now have the new free plan features. If the new way of counting contacts causes your audience to exceed 2,000 contacts before June 15, 2019, we'll automatically archive your unsubscribed and transactional contacts. After June 15, we'll begin calculating your audience as described in Section 7B of our TOU, but you can always manually archive contacts to keep your audience under 2,000 contacts. Data Processing Addendum (DPA) We're also making changes to our DPA, which explains our contractual obligations as a data processor under the GDPR when we process personal data about you and your contacts in connection with our services. Previously, Mailchimp users subject to the GDPR had to sign and submit an agreement. Now, we'll make it easier to comply with the GDPR by automatically incorporating the DPA into our TOU; it's available to read on our website. Who this affects If you're located in a member state of the European Economic Area, the United Kingdom, or Switzerland, or if you distribute content through Mailchimp to (or collect information through Mailchimp from) anyone located in those countries, you're now automatically a party to our DPA, so please be sure to review it at your earliest convenience. If you currently have a DPA on file with Mailchimp, you previously received an email (subject line: "Updates to Mailchimp's DPA") with more information. By continuing to use Mailchimp after the updated Standard Terms of Use are released, you agree to accept the updated Standard Terms of Use.
